All port lands are subject to the Sustainable Planning Act 2009 (SPA) and the Integrated Development Assessment System (IDAS).
All developments assessable under IDAS that are wholly on strategic port land will be assessed by the Corporation as the Assessment Manager under SPA. The Corporation assesses development applications against the approved Land Use Plan for its ports, including:-
The Corporation has developed a series of Planning Codes and Guidelines which are supporting documents that should be read in conjunction with the Port of Townsville Land Use Plan. The Planning Codes and Guidelines are used by the Corporation to assess whether a proposed development complies with the provisions of the Land Use Plan. These Planning Codes and Guidelines are currently in draft form and will be finalised on completion of public consultation on the Port of Townsville 2010 Land Use Plan.

Developments on all other lands owned or under the control of the Corporation but not designated as Strategic Port Land in the Land Use Plan remain assessable by the agency prescribed as the Assessment Manager under the SPA and regulations. For developments on non-strategic port lands, the Corporation's consent as Land Owner will be required.
In addition to the statutory planning and development approval requirements identified above, the Corporation has specific approval requirements under the Port Notices associated with specific operational and development works.
